Expert
Witness for the Courts and Various Tribunals |

As recognized experts in
the field of acoustics, the Valcoustics
staff are often called
to testify before the courts (civil and criminal) and other tribunals
(Ontario Municipal Board, Environmental Assessment Board, etc.) to
present the company's work on a specific project, to critique the
work of others or offer expert testimony on matters relating to acoustics.
Dr. Al Lightstone has appeared as an expert witness over eighty times.
Some
examples of projects involving official plan amendments, rezonings
and OMB hearings, on which we have been engaged are summarized below.
These are examples where compatibility of residential uses with neighbouring
industrial or commercial uses or with the environment in general were
major issues.

Environmental
noise and vibration impact assessment and mitigation measures for
this mixed land-use development adjacent to major roadway (Don Valley
Parkway) and two railway lines, for OPA and rezoning approval submissions;
participation in detailed acoustical design of the development;
expert witness testimony at the OMB (approved).

OPA
& rezoning for residential next to Paramount Canada's Wonderland
(PCW) and the Bai’tal Islam Mosque. Noise studies were prepared and
Dr. Lightstone appeared at the OMB hearing. Negotiated agreements
with PCW & the Mosque.

Bramalea South Gateway, Brampton |
Retained
by City of Brampton to assist in opposing private OPA to re-designate
existing industrial lands, including lands not owned by proponent,
for residential use. Area in question contained a variety of successful
existing industries. Various MOE guidelines and City planning policies
and principles were issues. Proposed OPA not approved by OMB.

Nabisco Brands Ltd. - Reid Milling (Mississauga) |
A
developer was attempting to re-zone land adjacent to the Reid Milling
plant to residential use. We successfully assisted Reid Milling in
their opposition to the development including giving testimony at
an Ontario Municipal Board (OMB) hearing.

F&P Stamping/Arvida (Alliston) - on behalf
of Arvida |
Assisted in successfully negotiating noise mitigation measures for
a new residential development adjacent to stamping plant, to ensure
compatibility of use, including expert testimony at OMB hearing.

Redpath Sugar/MT-27 (Toronto) - on behalf of Redpath |
Successfully
assisted in developing and negotiating detailed design concepts and
noise mitigation measures, including noise control at industry, to
permit adjacent residential development, including formulation of
detailed zoning by-law and tri-party agreement (industry/developer/municipality)
relating to noise control.

Chrysler/Tornorth/Cotrelle (Brampton) - on behalf of Chrysler of
Chrysler Canada Ltd. |
Successfully
assisted on negotiating major noise mitigation measures for proposed
residential development in proximity to Chrysler plant.
